CityLinc Partners, LLC Terms of Use

These Terms of Use (the "Terms") are a legal agreement between you and CityLinc Partners, LLC ("CityLinc", "our", "we", or "us"). These Terms apply to CityLinc’s mobile wireless services, website, mobile applications, and other interactive services provided in the United States (the "Services"). By using our Services, you agree to comply with these Terms.
2. Authority and Registration
- Eligibility: You must be at least 18 years old to use the Services independently. Users between 13 and 18 may only use the Services with legal parental or guardian consent.
- Account Security: You are responsible for maintaining the confidentiality of your username and password. You agree to notify CityLinc immediately of any unauthorized account use.
- Information Accuracy: You agree to provide true, accurate, and current information when registering for an account.
3. Services and Network Management
- MVNO Status: CityLinc operates as a Mobile Virtual Network Operator (MVNO). Services are provided using the facilities of underlying carriers; therefore, CityLinc does not actively manage the primary network infrastructure.
- Limitations: Services may be temporarily interrupted or limited due to atmospheric conditions, topography, network congestion, or maintenance.
- Network Practices: To maintain service quality, CityLinc may monitor network performance and engage in data throttling depending on your specific service plan.
4. Charges and Payments
- Billing: Recurring service fees, taxes, and regulatory fees are billed monthly in advance. Charges for international long-distance or data top-ups are billed at the time of purchase.
- No Proration: Adding an additional line requires a full monthly service charge at activation; charges are not prorated.
- Late Fees: Unpaid balances may incur a late fee of up to 1.5% per month ($18% per year) or a flat $10 fee, whichever is greater, subject to Georgia law.
5. Fair Usage Policy
You agree to use CityLinc Services in a lawful manner. Prohibited actions include, but are not limited to:
- Using the service for illegal purposes or to distribute "SPAM".
- Reselling the Service without authorization.
- Using equipment that harms the network or interferes with other users.
- Attempting to bypass security tools or reverse-engineer the Software.
6. Termination and Cancellation
- By You: You may stop using the Services at any time by calling CityLinc customer support. You remain responsible for the full monthly charge for the billing period in which you terminate.
- By CityLinc: We reserve the right to suspend or terminate your account for breaches of these Terms, non-payment, or fraudulent activity.
7. Dispute Resolution and Arbitration
PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS
- Binding Arbitration: You and CityLinc agree to resolve any disputes through binding, individual arbitration rather than in court.
- Location: Arbitration shall take place in Atlanta, Georgia.
- Class Action Waiver: You waive the right to participate in class-action lawsuits or class-wide arbitration.
- Opt-Out: You have the right to opt out of this arbitration provision within 30 days of first using the Services by emailing help@citylinc.com.
8. Disclaimers and Limitation of Liability
- "As Is" Service: Services are provided on an "as is" and "as available" basis without warranties of any kind.
- Liability Cap: To the maximum extent permitted by law, CityLinc’s total aggregate liability shall not exceed $100.
